LISTING GUIDELINES

You, as the Advertiser, are solely re responsible for ensuring that the adverts that you place are suitable, legal and decent.

This page gives specific guidance as to which adverts may not be placed on our services, but is not exhaustive, if you are unsure of whether your product can be listed, please Contact Us.
We reserve the right to edit, remove or reclassify any advert at our discretion.

Language

  • Adverts using graphic, obscene or racist language are not allowed and will be deleted without recourse.

Copyright and Trademark

  • Adverts containing illegal copies or backups of software and games are not allowed.
  • Trademarked items or use of trademarks or images in adverts must be permitted by the trademark owner. We accept no responsibility for policing the use of trademarks, and if a trademark owner suspects an infringement, they must contact the advertiser, not us, to resolve the complaint.

Stolen Goods

  • If an item is reported as stolen, the listing may be removed and your account monitored. Further infringement may be reported to the relevant Authorities.
  • If you suspect an item to be stolen, please contact the relevant authorities for investigation.

Animals

  • All adverts for animals must adhere to the RSPCA’s guidelines for online sale of animals or pets: https://kb.rspca.org.au
  • We are not responsible for the wellbeing of pets or animals advertised on our websites. If you suspect that an animal featured in an advert may be suffering or in danger, you should contact the RSPCA or the Police.

Animal and Wildlife Products

The following guidance is for animal products, not live animals (covered above)
Some adverts for animal and wildlife products (including taxidermy) are permitted but there are others which are not based on their animal origin. It is your responsibility to ensure that an animal product complies with UK Law, more information is available here: https://www.gov.uk/government
Any adverts that contravene these laws must be brought to our attention.

Weapons

As a general rule, weapons are not allowed to be advertised our website. It is entirely the responsibility of the Advertiser to ensure that the item they are offering complies with the Offensive Weapons Act 2019 (and amended) https://assets.publishing.service.gov.uk/government/

Adult Videos and DVDs

  • R18 videos are allowed, excluding pornography and home-made videos. All videos or DVDs offered for sale must have a valid https://bbfc.co.uk/ rating.

Lingerie

  • We only accept advertisements for lingerie and underwear that is new and unworn. Images of Lingerie must not include models. We use automatic software to detect nudity, so if your advert has been de-listed, please contact us for clarification

Massage & Therapy

  • Adverts offering massage, therapy or counselling services must be for a registered practice and have a valid insurance policy covering public liability and professional indemnity.

Adult Services

  • Adverts for sexual or escort services are not accepted.

This page defines the terms and conditions that you agree to by using any of the websites, applications, portals or sub-domains, as a visitor or registered user.
It is your responsibility to read and understand these Terms, which may change without notice.
During the Registration process you may be asked to confirm that you have read and understood these Terms, so if you do not agree to these Terms please leave the site without continuing, any details entered up to that point will not be saved.

2. Definitions used in these Terms
  1. "Confirmation" means our e-mail confirmation to you that you have become a Registered User or Upgraded User (as the case may be).
  2. "Content" means any information, text, logos, messages, details, screen names, photographs, graphics, software, files, sounds, and all other material on NewburyBargains.co.uk.
  3. "Items" means the details of any goods or services that have been uploaded or added to NewburyBargains.co.uk.
  4. "Minor" means a person under 18 years of age.
  5. "Post" means to upload or display for sharing in public.
  6. "Premium User" means a Business Owner who has paid additional monies for additional functions within the services.
  7. "Registered User" means anyone agreeing to these Terms during the Registration process.
  8. "Services" means any services provided by us though our website, applications, portals or sub-domains, via email or by telephone.
  9. "Terms" includes all our Terms of Use and our Privacy Policy, as well as any other referenced documents

3. Our Websites
  1. Are legally defined as venues, and as such, registered users may express their opinions, as long as they are not insulting, defamatory, racist, homophobic or pornographic, or in breach of any of our Terms
  2. Use of our websites does not constitute responsibility for upholding of contracts for the supply of goods between you and another users.
  3. Our website does not facilitate payment for goods or services advertised, any contract formed, whether verbal or in writing via our website, between you and another user, is your responsibility not ours. We hold no responsibility for contracts made between buyers and sellers through the site.
  4. Any warranty, implied or explicit, is the responsibility of the seller. Whilst we take no responsibility for any Warranty, this statement does not affect your statutory rights against another user of our websites. Further information is available from your local Trading Standards Officer.
  5. By accepting our Terms, you agree to comply with our acceptable use policy, outlined below. It is your responsibility for ensuring that anyone using your internet connection is aware of, and complies with, these Terms
  6. Occasionally, we may need to block access to some parts of the Website, for operational or security reasons.
4. Registered Accounts and User IDs
  1. You must not create multiple accounts, whether by hand or by the use automated software or bots. Membership of the websites has no monetary value and cannot be sold or transferred to another party.
  2. Your user name must not contain any swear words or expletives in English or any other language. In addition, it may not imply any connection with us. For example, your user name must not include the word “bargain” or imply a position of authority such as “administrator”.
  3. We reserve the right to ask you to change your username, refusal to do so may result in account suspension.
  4. Password security is your responsibility, you must not disclose it to any third party. The construct of the password should be sufficiently complicated so as not to be easily guessed. Should you become aware of any security breach, you must inform us immediately.
  5. We reserve the right to disable any user whose password in our opinion, fails to comply with our Terms.
5. User Registration
  1. In signing up for membership of our website, you are confirming the following:

  2. We are not responsible, or liable whatsoever, for any wording that you put in your posts, posted by you or any other user of our services.
  3. You must not use or allow anyone else to use your login to post any Items, they must register as a user themselves.

  5. Advertisers who are suspected of illegal activities may have their details passed to the authorities without prejudice.
  6. By using our services, you undertake to indemnify us for any breach of law that your advert(s) may contain.
  7. We are under no duty or obligation to you to monitor or record the activity of any website user or visitor.
  8. Electronic Communications, of all kinds including confirmation emails and SMS text messages are sent by our systems through third party systems, we cannot guarantee confidentiality, therefore confidential material should not be sent via our systems.
  9. We assume no responsibility for the deletion or failure to store messages or other Content. Sometimes technology fails and we cannot be held responsible.
7. Other Users of our services
  1. By using our website, you understand that you may come in contact with individuals or companies wishing to purchase your advertised item, we take no responsibility for the behaviour or content of that individual or company. You make contact with them at your own risk, and agree to indemnify us from any liability resulting from such contact.
  2. You understand that we cannot verify the identity of other users. Some users may not be who they say they are, and we bear no responsibility for these situations.
8. Intellectual Property Rights
  1. In the act of loading content to our services, you accept that you are relinquishing control over the content. We are not responsible for third parties copying, printing or otherwise distributing such content.
  2. Our websites do not use watermarking or digital (EXIF) tagging on images, before loading your images, you should ensure that any personally identifiable information is removed from the imagery.
  3. You must not use any Content or part of content from our services without obtaining written licence to do so from us.
  4. If you use our site, you are responsible for all content that is loaded to the site. We are not responsible for policing or moderating the content of your posts.
  5. You MUST have ownership rights or permission to use any images you upload to this website. We will not be responsible for verifying ownership, copright or intellectual property rights for any content uploaded by our users.
9. Viruses, Hacking and Other Offences
  1. You must not misuse our services by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our services, the server on which they are located, or any server, computer or database connected to our services. You must not attack our services via a denial-of-service attack or a distributed denial-of service (DDOS) attack.
  2. Any breaching this provision, will be reported to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our services will cease immediately.
  3. We will not be held liable for any loss or damage caused by malicious attacks on our services.
10. Events Outside Our Control
  1. We will not be liable or responsible for any matter arising out of or in connection with events outside our reasonable control, commonly known as Force Majeure Events.
